CONCERNING GENERAL PRODUCT SAFETY

This document has been created and adopted by SAPSAN CYBERSEC sp. z o.o. with its registered office at ul. Objazdowa 14/14A, 43-430 Skoczów, NIP: 5482759191, REGON: 528368671 (hereinafter: "Seller"), as part of the obligations arising from Regulation (EU) 2023/988 of the European Parliament and of the Council of 10 May 2023 on general product safety, amending Regulation (EU) No 1025/2012 of the European Parliament and of the Council and Directive (EU) 2020/1828 of the European Parliament and of the Council, and repealing Directive 2001/95/EC of the European Parliament and of the Council and Council Directive 87/357/EEC (OJ EU.L.2023.135.1 of 2023.05.23, hereinafter: GPSR).
The Seller indicates that via the website at www.sapsan-sklep.pl, it offers goods that are safe products and comply with the general safety requirement within the meaning of GPSR.
1. Information about the manufacturer and product identification
The offer for each product includes, in particular:
-
information concerning the manufacturer of the goods or the person responsible for the product placed on the market in the European Union (name, trademark, postal address, and email address);
-
information enabling the identification of the goods (e.g., image, type, model designation, numbers, or other identifiers).
Warnings and safety information are placed on the goods, on their packaging, or in an accompanying document (e.g., instructions, product sheet).
2. Information about dangerous products
Current information on dangerous products is available, among others, on:

3. Seller's obligations in case of dangerous products
The Seller informs that it is obliged to take appropriate actions in cases where goods sold to consumers turn out to be a dangerous product.
In this regard, the Seller is entitled to use the possessed consumer data to:
-
provide information about product recall (recall actions / withdrawal from the market),
-
provide safety warnings.
Consumers may be asked to voluntarily provide additional information to the manufacturer or the responsible entity, such as:
-
name and surname,
-
contact details,
-
product model or serial number.
4. Legal remedies in case of product recall
In the case of dangerous products, the entity responsible for the product recall (usually the manufacturer) should provide consumers with a product recall notice containing information about the dangerous product and the available legal remedies.
As part of the legal remedies, the consumer should be offered a choice of at least two of the following solutions:

Repair of the goods;
-
Replacement of the goods with a safe product of the same type and at least the same value and quality;
-
Appropriate refund of the goods' value, provided that the refund amount is at least equal to the price paid by the consumer.
As an exception, the obligated entity may offer the consumer only one legal remedy if other remedies would be impossible to apply or would impose disproportionately high costs.
5. Costs and inconvenience for the consumer
The applied legal remedy:
-
must not cause significant inconvenience to the consumer,
-
must not involve costs for the consumer – the consumer does not bear the costs of shipping or other costs of returning the goods.
In the case of goods which, due to their nature, are not portable, the obligated entity shall arrange for the collection of the goods from the consumer.
Detailed rules and procedures will be determined each time by the specific product recall notice.
6. Relation to other consumer rights
The above regulations do not exclude consumer rights arising from the non-conformity of the goods with the contract, available under the Act of 30 May 2014 on Consumer Rights and other generally applicable laws.
The consumer should exercise their rights in a manner appropriate to the situation, in particular taking into account:
-
the nature of the defect or hazard,
-
recommendations contained in the product recall notice,
-
applicable laws.
7. Products excluded from GPSR
The above information does not apply to products that are not covered by the scope of GPSR, in particular:
-
medicinal products,
-
food (including food supplements),
-
feed,
-
living plants and animals,
-
plant protection products,
-
animal by-products and derived products,
-
antiques.
